1. Acceptance of Terms

By creating an account or using BidCraft (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

BidCraft is an AI-powered proposal writing platform for contractors and tradespeople. We use Anthropic's Claude AI to help generate, edit, and manage proposals. The AI-generated content is provided as a starting point — you are responsible for reviewing and verifying all proposals before sending them to clients.

3. AI Disclaimer

Proposals generated by BidCraft are created by artificial intelligence and may contain errors, omissions, or content that does not accurately reflect the specifics of your job. You must review every proposal before sending it to a client. BidCraft is not liable for any losses, disputes, or damages arising from the use of AI-generated proposal content.

4. Account Responsibilities

• You must be at least 18 years old to use BidCraft.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree not to use the Service for any unlawful purpose.
• One account per person or business entity. You may not share your account credentials.

5. Subscription and Billing

• Free Plan: Includes up to 3 proposals per calendar month at no charge.
• Pro Plan: Billed at $19/month via Stripe. Provides unlimited proposals and additional features.
• Subscriptions renew automatically until cancelled.
• You may cancel at any time from your account settings. Cancellations take effect at the end of the current billing period.
• We do not offer refunds for partial months.

6. Refund Policy

All sales are final. We do not offer refunds for monthly subscription charges. If you believe a charge was made in error, contact us within 7 days at support@bidcraft.app and we will review your case.

7. Intellectual Property

• You retain ownership of the content you input into BidCraft (job descriptions, client data, etc.).
• You own the proposals generated using your inputs.
• BidCraft retains all rights to the platform, its design, and its underlying technology.

8. Prohibited Use

You agree not to:

• Attempt to reverse-engineer or scrape the Service
• Use the Service to generate fraudulent or deceptive proposals
• Exceed API rate limits or circumvent usage restrictions
• Resell or sublicense access to the Service
• Upload malicious files or content

9. Limitation of Liability

To the maximum extent permitted by law, BidCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities, arising from your use of the Service. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Virginia.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
